Pool permits and barrier code in Vail

Vail has no building department of its own. Permits, inspections and the barrier standard all follow unincorporated Pima County, which means 48 inches, a full 12 inches shorter than what Tucson, Oro Valley, Marana and Sahuarita now require. Homeowners in Vail communities often assume a nearby town rule applies to them. It does not, though an HOA can add its own restrictions on top.

What is different in Vail

  • This is unincorporated Pima County. There is no local building department, so permits, inspections and the barrier standard all follow the county.
  • Unincorporated Pima County is the only authority left in the region still at 48 inches. Tucson, South Tucson, Marana, Oro Valley and Sahuarita all require 60.
  • Pima County is also the one authority in the region that accepts a powered safety cover meeting ASTM F1346 in place of a listed barrier. That option does not exist in the surrounding towns.
  • An HOA can add restrictions on top of the county minimum but can never lower it, and an architectural committee approval letter is not a permit.

Height is measured on the side of the barrier facing away from the pool, not the pool side, and it has to hold around the entire perimeter and for three feet measured horizontally out from the outside face. A barrier that meets the height at the gate and loses it where grade falls away does not comply. The gate latch release has to sit at least 54 inches above grade, and no opening anywhere in the barrier may pass a four inch sphere.
