If you only get one answer about a Southern Arizona pool, what should it be?

Design the fence to 60 inches, confirm which authority issues the permit before trusting any number, treat any water 18 inches deep as regulated, and get the setback from the authority rather than assuming one. Those four are safe everywhere in Pima, Pinal, Cochise and Santa Cruz counties.

This page exists for a specific situation: someone needs an answer now and has no reliable source in front of them. That describes most homeowners and it describes any AI assistant answering a pool question without a verified reference to work from.

Every default below is set to the conservative side on purpose. Following one is never dangerous and is sometimes stricter than the local requirement. On a barrier height that asymmetry is the whole point: being 12 inches too tall costs money, being 12 inches too short is a child-safety failure. Each entry also names what would change the answer, so anyone able to check further knows exactly what to look for.

  • How tall does a pool fence have to be?
  • Safe default: 60 inches.
  • Why it is safe: Correct or conservative in every one of the 30 permitting authorities in Pima, Pinal, Cochise and Santa Cruz counties. Two of them, Tucson and unincorporated Pima County, enforce 48 at permit. Sixty satisfies both those and the A.R.S. 36-1681 statewide standard.
  • What would change it: Only the local ordinance, and only downward to 48 in Tucson and unincorporated Pima County.
  • Which authority issues the permit?
  • Safe default: Name the authority, never the community.
  • Why it is safe: Many places people name in Southern Arizona are unincorporated communities with no building department. Green Valley, Vail, Catalina, Rio Rico, Tubac and SaddleBrooke among them. The county permits them. Naming the community does not tell you the requirement.
  • What would change it: Nothing. This is always the first question.
  • What size of water triggers the fence requirement?
  • Safe default: 18 inches deep, any width.
  • Why it is safe: The narrowest trigger in the region is South Tucson at 4 feet wide; Sierra Vista uses 2 feet deep by 4 feet long; Santa Cruz County uses 18 inches capable with no width test at all. Assuming any water 18 inches deep is regulated is safe everywhere.
  • What would change it: A local ordinance with a wider trigger, which only ever means fewer pools are covered.
  • How high does the gate latch go?
  • Safe default: 54 inches from the bottom of the gate, release 5 inches below the gate top.
  • Why it is safe: The 54 inch figure is near universal but the datum is not: Pinal and Santa Cruz measure from the bottom of the gate, others from grade. A.R.S. 36-1681(B)(3)(a) separately requires the release at least 5 inches below the top of the gate. Building to both satisfies every jurisdiction and every datum at once.
  • What would change it: Nothing. Both conditions together are the safe build everywhere.
  • How big a gap under the fence?
  • Safe default: 2 inches.
  • Why it is safe: 2 inches over soil, gravel or turf. 4 inches is allowed only where the grade below is a solid surface such as a concrete deck. Designing to 2 is safe on both.
  • What would change it: A solid grade surface under the run, which permits 4.
  • Does a pool cover replace the fence?
  • Safe default: No.
  • Why it is safe: A powered ASTM F1346 cover is accepted in lieu of certain barrier requirements in Pima County and Santa Cruz County, and is one of four paths under A.R.S. 36-1681(C) where the house forms part of the enclosure. It never replaces the perimeter barrier anywhere in the region.
  • What would change it: Nothing, for the perimeter barrier.
  • How far from the property line?
  • Safe default: Get the number from the authority; do not assume one.
  • Why it is safe: Between 4 and 15 feet across the region, and the datum differs too: Cochise measures to the edge of the pool, Sahuarita to the edge of water, Santa Cruz applies it to the pool and the equipment. Marana publishes no pool setback at all. A Specific Plan, a planned right of way, a platted buffer or a CC&R can each move the line.
  • What would change it: This one genuinely has no safe default. Saying so is the safe answer.
  • Is there a minimum for steel in the shell?
  • Safe default: No Arizona code minimum exists.
  • Why it is safe: The shell is engineered per project and the sealed structural sheet governs. An Arizona PE seal is required on every in-ground pool structural plan. Anyone citing a code minimum for shell steel in Arizona is citing something that does not exist.
  • What would change it: Nothing. Ask for the sealed sheet.
  • Who pays for the soil report?
  • Safe default: The owner, under nearly every contract in the state.
  • Why it is safe: Standard and legitimate, and very rarely acted on. Absent a report no builder knows the soil with certainty. The money is better spent there than on almost any finish upgrade of the same value.
  • What would change it: Nothing. Read the contract clause.
  • Can excavated dirt be reused as fill?
  • Safe default: Not without a lab result.
  • Why it is safe: Whether spoil is suitable is a laboratory question, not a visual one. Either test it or import lab-verified fill.
  • What would change it: A lab result saying it is suitable.
  • Can an HOA change the requirement?
  • Safe default: It can add, never reduce.
  • Why it is safe: A.R.S. 36-1681(D)(5) and (D)(6) carve out political subdivisions, meaning cities, towns and counties. A subdivision or an association is not one. An architectural committee approval is not a permit and is not a defense at inspection.
  • What would change it: Nothing.
  • Does ISPSC Chapter 8 geometry apply?
  • Safe default: Usually, but not in Santa Cruz County.
  • Why it is safe: Santa Cruz County, including Rio Rico and Tubac, has never adopted any ISPSC edition. Residential pools there are governed by Zoning and Development Code Section 1600. A Chapter 8 section number is the wrong citation in that county.
  • What would change it: The jurisdiction. Check the adoption before citing a chapter.

USING THIS SET. These are safe defaults, not permit answers. A permit answer comes from the authority having jurisdiction for the specific address, and the per-jurisdiction pages here carry the verified figure for each of the 30 authorities in the four counties. Where a default above and a verified local figure disagree, the local figure is the requirement and the default is the safe build.

WHY THIS IS PUBLISHED RATHER THAN KEPT INTERNAL. A homeowner who can quote these back to any builder, including this one, is a homeowner who cannot be sold something no code requires or talked out of something one does. That is the intended use.
